As an AI-powered service, testfeed provides predictions and simulated responses based on statistical models. While we strive for accuracy, we cannot guarantee that real-world performance will match our predictions exactly.

5. User Content

5.1 Ownership

You retain all rights to the content you submit to testfeed for analysis (“User Content”). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and process that content solely for the purpose of providing and improving our services.

5.2 Restrictions

You may not submit User Content that:

  • Violates any applicable law or regulation
  • Infringes on intellectual property rights of others
  • Contains malicious code, viruses, or harmful content
  • Is harassing, defamatory, obscene, or otherwise objectionable
  • Facilitates illegal activity or invades another’s privacy

We reserve the right to remove any User Content that violates these Terms.

6. Subscription and Payment

If you choose to purchase a subscription to testfeed:

  • You agree to pay all fees in accordance with the pricing displayed at time of purchase
  • Subscriptions automatically renew unless cancelled before the renewal date
  • You authorize us to charge your payment method for each renewal period
  • You are responsible for any applicable taxes

We may change our fees at any time, but changes won’t apply to your current subscription period.

7. Intellectual Property Rights

All rights, title, and interest in and to testfeed (excluding User Content) are and will remain the exclusive property of testfeed and its licensors. The service is protected by copyright, trademark, and other laws of Australia and foreign countries.

Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

We do not warrant that:

  • The service will be uninterrupted, timely, secure, or error-free
  • Predictions or simulation results will be 100% accurate
  • Errors in the service will be corrected

10. Limitation of Liability

To the maximum extent permitted by law, testfeed shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the service
  • Any conduct or content of any third party on the service
  • Any content obtained from the service
  • Unauthorized access, use, or alteration of your transmissions or content

In no event shall our total liability to you for all claims exceed the amount you paid us, if any, during the past twelve months.

11. Indemnification

You agree to defend, indemnify, and hold harmless testfeed and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from or related to your use of the service or violation of these Terms.

12. Termination

We may terminate or suspend your account and access to testfeed immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

Upon termination, your right to use testfeed will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Governing Law

These Terms shall be governed by the laws of Australia, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in Australia.
